Nap Nanny and Chill Infant Recliners Recalled by Baby Matters LLC After Five Infant Deaths; CPSC, Firm Settle Administrative Litigation

WASHINGTON, D.C.–In cooperation with the U.S. Consumer Product Safety Commission (CPSC), Baby Matters LLC of Berwyn, Pa., is announcing a voluntary recall of all models of its Nap Nanny and Nap Nanny Chill infant recliners and covers. This recall is announced as part of the settlement of an administrative case filed by CPSC in December 2012, which sought a mandatory recall of the Nap Nanny and Chill products.

From 2009 to the present, the Commission staff has received at least 92 incident reports involving the Nap Nanny and Nap Nanny Chill products, including five infant deaths. CPSC is aware of four infants who died in Nap Nanny Generation Two recliners and a fifth death involved in the Chill model. In the incident reports received by CPSC, there were 92 reports of infants hanging or falling over the side of the products, including some infants who were restrained in the product’s harness.

CPSC urges consumers to immediately stop use of all Nap Nanny and Nap Nanny Chill recliners.  Baby Matters LLC is no longer in business and is not accepting returns.  In December 2012, four major retailers-Amazon.com, Buy Buy Baby, Diapers.com, and Toys R Us/Babies R Us-announced a voluntary recall of Nap Nanny and Chill models sold in their stores.  Consumers who purchased a Nap Nanny from one of these retailers should contact the retailer for instructions on how to obtain a refund for the product.

CPSC urges other consumers to immediately dispose of the products to ensure that they are not used again.

About 165,000 of the Nap Nanny and Chill products were sold between 2009 and 2012 for about $130. The recalled products were sold at toy and children’s retail stores nationwide and online, including at www.napnanny.com.

In December 2012, CPSC staff filed an administrative complaint against Baby Matters LLC seeking a recall of the Nap Nanny and Nap Nanny Chill infant recliners.  CPSC staff and Baby Matters LLC reached a settlement agreement that includes the recall announced today and ends the legal proceeding against the firm.

The settlement resolves CPSC staff’s allegations that the Nap Nanny and Chill products create a substantial product hazard. CPSC alleged that the products contain a design defect, their use presents a risk of injury to infants, and the instructions and warnings are inadequate.  Baby Matters disputed these allegations but has agreed to the recall in consideration for dismissal of the CPSC lawsuit.

It is illegal under federal law for any person to sell, offer for sale, manufacture, distribute in commerce, or import into the United States any model of the Nap Nanny or Chill recliner or the covers.

The bottle is brown with a black top and has a white label with a yellow banner at the top and a green banner at the bottom. The words “IRON,” “Country Life” and “90 tablets” are printed on the label. Bar code 015794024927 and Lot Number 13A866B are printed on the far left side of the front label.

Remedy: Consumers should immediately place recalled bottles out of the reach of children and return them to the place of purchase for a full refund or a replacement bottle.

Description: This recall involves Pottery Barn Kids Sweet Lambie Bumpers manufactured from April 2009 through July 2012. The cotton bumpers are padded and fit standard cribs. Lambs in grass and lambs with trees are embroidered on the interior and exterior of the bumpers. They were available in the colors pink, blue and ivory/oatmeal. Model number  АЬ70885  т Э   Ь708917  Э or  АЬ79883  т Э and  АЬSweet Lambie Bump  т Э appear on a tag fastened to the bottom edge of the bumpers. The date of manufacture in MM/YYYY format is printed on a tag attached to the bumper near the model number tag.

Incidents/Injuries:  The firm has received two reports of the decorative stitching coming loose and entangling children, including reports of the thread wrapping around a child  Щs neck. No serious injuries have been reported.

H&M Reannounces Recall of Children’s Water Bottles Due to Choking Hazard

Hazard:  The water bottle’s spout can break off, posing a choking hazard to children.

Description: This recall includes previously recalled 16 oz. plastic water bottles that came in pink with a crackle design or blue. The bottles have flip-top lids in coordinated pink and blue colors. “H&M Sweden,” www.hm.com and a date clock with the manufacture date are embossed on the bottom of the bottle. The recalled products were manufactured in June 2012. The inner circle on the date clock stamp contains the number 12 with an arrow between the two numbers. The arrow points at the number 6 in an outer circle of numbers.

Incidents/Injuries: H&M has received one report of an incident in England of the water bottle spout breaking off in a child’s mouth as the child was drinking from the bottle. No injuries have been reported.

Sold exclusively at:  H&M stores with children’s departments nationwide from July 2012 through March 2013 for between $1.50 and $5.  About 200 of the bottles were sold after the original recall was announced in September 2012.

Incidents/Injuries: There have been 22 reports of incidents involving the recalled beds in the U.S. since 2009 and one in Canada. Two injuries were reported. In a 2009 incident in Madison, Wisconsin, an 11-year-old girl was placing a fitted sheet on the top bunk when the child, mattress and bed supports collapsed on her 6-year-old sister in the bed below. The 6 year old was treated at a hospital emergency department for a head injury involving a cut to her face.

Remedy: Consumers should immediately stop using the beds and contact Lea Industries to receive free replacement side rails for the beds.

Deezo Children’s Hooded Sweatshirts with Drawstrings Recalled by Zulily Due to Strangulation Hazard

Name of product: Deezo boys and girls zip-up hoodies

Units: About 560

Hazard:  The sweatshirts and jackets have drawstrings through the hood which pose a strangulation hazard to young children. In February 1996, CPSC issued guidelines about drawstrings in children’s upper outerwear. In 1997, those guidelines were incorporated into a voluntary standard. Then, in July 2011, based on the guidelines and voluntary standard, CPSC issued a federal regulation. CPSC’s actions demonstrate a commitment to help prevent children from strangling or getting entangled on neck and waist drawstrings in upper outerwear, such as jackets and sweatshirts.

Remedy:  Consumers should immediately take the garments away from children. Consumers can remove the drawstrings to eliminate the hazard or return the garments to Zulily for a full refund. Contact Zulily to obtain a return address label and instructions for returning the garment.

Description: This recall involves a Deezo brand boys’, girls’, and toddlers’ zip-up hoodies made of 65% polyester and 35% cotton.  The sweatshirts and jackets have designs that include a heart with arrow, swirl, alien, flower, guitar, motor scooter and circuit board designs and come in the following color combinations: pink with white or black trim; white with pink or green trim; blue with a light blue and white trim and black with blue or green trim.

The following model numbers are included in the recall: 12501, 2502, 12503, 12504, 12505, 12506, 12507, 12508, 12509, 12801, 12802, 12803, 12804, 12806, 12807, 12808, 12809, 12810. Model numbers are located on the care label sewn into the garments side seam? The garment’s hangtag has “happyfashion4kids www.deezo.com.au” printed on it.

Children’s Apparel Network Recalls Girl’s Clothing Sets; Waist Belt Poses Risk of Entrapment

Recall Summary

Name of Product: Girl’s Three-Piece Clothing Sets

Hazard: The vest sold with these sets has a belt at the waist that could become snagged or caught in small spaces or vehicle doors and it poses an entanglement hazard. In February 1996, CPSC issued guidelines about drawstrings in children’s upper outerwear.
In 1997, those guidelines were incorporated into a voluntary standard. Then, in July 2011, based on the guidelines and voluntary standard, CPSC issued a federal regulation. CPSC’s actions demonstrate a commitment to help prevent children from strangling or getting entangled on neck and waist drawstrings in upper outerwear, such as jackets and sweatshirts.

Description: This recall involves girl’s “Young Hearts” brand three-piece clothing sets. The sets were sold with a pink vest, black pullover shirt and knit pants in sizes 12 months to 6X. “Young Hearts” is printed on a label inside the shirt collar. The pink vest has a black bow applique on the left front and a pink elastic belt with silver clasps.

Incidents/Injuries: None reported.

Remedy: Consumers should immediately remove the belt from the vest to eliminate the hazard, or return the set to the store where purchased for a full refund.

Sold at: Conway, Citi Trends, Duckwall-Alco and other children’s apparel stores nationwide and online at Amazon.com from September 2012 to December 2012 for about $40.
